Question by : Is it ok to drink alcohol while on probation for a non alcohol related violation for disorderly conduct?
Basically the terms of the probation didn’t say anything about refraining from alcohol just not to get re-arrested for any violation and to attend counseling sessions. I am not that much of a drinker anyway though, so I don’t think it would be much of an issue to have a beer on occasion

It would be a risk to drink in public, so if you want a beer then do it at home.

Question by : PO’s recommendations on probation violation of drinking to excess?
A friend of mine was recently violated by his Probation Officer because he was found intoxicated. The PO is now going to recommend that my friend get in-patient treatment for alcoholism which means that he could spend some time in jail until a place is available at a treatment facility. What is the likelihood that the judge will go along with this considering that the probation is about to end and that all fees (except for court fines) have been paid and this is his first violation?

Question by Rob: I was in alcohol treatment, I signed a release of information to probation officer and municipal court?
This information got out to other city employees not from yhe court. This then in turn got back to my employer, coworkers, my bussness contacts and family. This court is in Ohio, it is my understanding that most court records are public, one exception being medical records. It also seems to me this information should be protected under federal HIPPA laws.
Do I have any recourse against the courts for this?

My Soldier is in the trial process for DUI in the state of Washington. One of his options is deferred prosecution, which is a program that includes rigorous alcohol and drug education and counseling. The problem with this program is that a probation of 5 years is added to the mix. I don’t want my Soldier to be ineligible for promotion for 5 years if he will be flagged for the entire period of his probation. The reg on Suspension of Favorable Actions doesn’t say anything about probation from a civilian court. Anybody have any experience with this sort of thing?
